Puerto Rico Doctors Must Again Defend Against Malpractice Suit
The son of a Puerto Rican man who died in a hospital after abdominal surgery can again accuse several physicians of medical malpractice, the First Circuit said.
A federal district court erroneously found that plaintiff Yemal Calderon-Amezquita’s claims against some defendants were too late under a one-year statute of limitations, Judge O. Rogeriee Thompson of the US Court of Appeals for the First Circuit said in a Thursday opinion.
This decision reversed and vacated summary judgment for those defendants, while affirming summary judgment for defendant Grupo de Emergencias VRC CSP, which administered the hospital’s emergency room.
